In Pennsylvania, employees are presumed to be at will unless they work under an employment contract. At will employees can be terminated for any reason so long as the firing is not contrary to public policy. Employees who work under an employment contract can generally only be terminated for reasons specified in the contract.

At will employees may have an action for wrongful termination if their termination is based on discrimination or violates established public policies. Employers cannot terminate employees because of their age, race, sex, religion, national origin, disability, or because they are pregnant. Additionally, employers cannot terminate employees (1) for refusing to violate the law; (2) in retaliation for filing a discrimination or safety claim; (3) for exercising a statutory or constitutional right (as where an injured worker files a claim for workers' compensation benefits and the employer fires him/her); and (4) for taking leave under the Family and Medical Leave Act.
